Please read these Terms and Conditions carefully before using Hasta Media, playing its browser games, submitting comments, or accessing related features. By accessing or using the Service, you agree to these Terms. If you do not agree, please discontinue use of the Service.
Interpretation and Definitions
Interpretation
Words with initial capital letters have the meanings defined below. The definitions apply whether the words appear in singular or plural form.
Definitions
- Company, also referred to as "we", "us", or "our", means Hasta Media.
- Content means articles, game descriptions, artwork, images, code, comments, interface elements, and other material made available through the Service.
- Device means a computer, phone, tablet, or other device capable of accessing the Service.
- Game means a browser-based game, interactive experience, demonstration, or related feature made available through the Service.
- Service means the Website, its pages, Games, and related features.
- Third-Party Service means an external website, platform, advertisement, embedded resource, analytics provider, or other service not controlled by us.
- User Content means comments, messages, feedback, images, text, or other material submitted by a user.
- Website means Hasta Media at hastamedia.biz.id.
- You means the individual using the Service or the organization on whose behalf that individual acts.
- Country means Indonesia.
Acknowledgment and Acceptance
These Terms govern your access to and use of the Service and form an agreement between you and the Company. Your use of the Service is also subject to our Privacy Policy and Disclaimer, which are incorporated into these Terms by reference.
If you use the Service on behalf of an organization, you represent that you have authority to accept these Terms for that organization.
Age and Parental Permission
The Service is intended for a general audience and is not directed to children under 13. If you are below the age at which you can legally agree to these Terms in your country, you may use the Service only with the permission and supervision of a parent or legal guardian.
A parent or guardian who permits a minor to use the Service is responsible for supervising that use and helping the minor understand safe browser, advertising, privacy, and gameplay practices.
Access to the Service
Most Games and pages are currently offered for personal access through a supported web browser. The Service generally does not require a Hasta Media user account or paid subscription unless a page or feature clearly states otherwise.
If accounts, purchases, competitions, memberships, cloud saves, or other new services are introduced, additional terms or notices may apply. Those additional terms will supplement these Terms for the relevant feature.
Limited License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access the Service and play the Games for lawful, non-commercial purposes.
This license does not transfer ownership of any Game, code, artwork, design, Content, or intellectual-property right to you.
Game Use and Responsible Play
You are responsible for deciding whether a Game is suitable for you, using appropriate sound, brightness, motion, and fullscreen settings, and taking reasonable breaks. Stop playing if you experience discomfort, dizziness, eye strain, nausea, disorientation, or seizure-like symptoms.
You must not use a Game in a way that creates an unsafe distraction, including while driving, operating machinery, or performing an activity that requires continuous attention.
Game Progress, Scores, and Browser Storage
Some Games may use cookies, local storage, or similar browser technologies to remember progress, scores, sound settings, display choices, or other preferences. Unless clearly stated otherwise, local Game data is stored on your Device and is not a permanent cloud backup.
We do not guarantee preservation, synchronization, portability, accuracy, or recovery of locally stored progress or scores. Clearing site data, using private browsing, changing Devices, browser restrictions, software updates, technical faults, or redesigns may reset or remove stored information.
Acceptable Use
You agree not to use the Service to:
- violate applicable law, regulation, court order, or another person's rights;
- upload, transmit, introduce, or distribute malware, malicious code, harmful files, or disruptive scripts;
- attempt to gain unauthorized access to the Service, hosting environment, administrative areas, data, accounts, or related systems;
- interfere with security controls, rate limits, access controls, consent mechanisms, advertising systems, or technical safeguards;
- use bots, scrapers, crawlers, automated extraction, bulk downloading, or data-mining tools in a manner that places an unreasonable burden on the Service, bypasses technical measures, or exceeds permission granted by law or in writing;
- manipulate Game scores, exploit defects, falsify interactions, automate gameplay, or present altered results as authentic where that conduct affects other users, competitions, rankings, or Service integrity;
- frame, mirror, republish, sell, rent, sublicense, or commercially exploit the Service or a substantial part of it without written permission;
- impersonate another person, misrepresent affiliation, or submit fraudulent, defamatory, hateful, harassing, infringing, or unlawful material;
- encourage accidental or invalid advertising clicks, obscure advertising labels, or represent an advertisement as a required Game control;
- use the Service in a way that materially disrupts another person's access or enjoyment.
Advertising and Sponsored Material
The Service may display advertisements, sponsored placements, affiliate references, or promotional material. Advertising is separate from our ordinary editorial Content and Game controls unless clearly stated otherwise.
You are never required to click an advertisement to play a Game, continue playing, save progress, improve a score, or receive a reward from Hasta Media. Advertisements and advertiser destinations are governed by the advertiser's own terms and privacy practices.
Where applicable, material relationships, sponsorships, or affiliate arrangements will be disclosed in a reasonably clear manner.
Intellectual Property
Unless otherwise stated, the Service and its original Games, code, artwork, writing, visual identity, user interface, layout, branding, and other Content are owned by the Company or used under permission and are protected by applicable copyright, trademark, and other intellectual-property laws.
Except where permitted by law or written permission, you may not reproduce, modify, adapt, translate, distribute, publicly display, sell, license, reverse engineer, decompile, extract source code from, or create derivative works from protected parts of the Service.
Nothing in these Terms prevents lawful quotation, criticism, review, reporting, research, interoperability, or another exception or limitation recognized by applicable law.
Copyright and Rights Complaints
If you believe material available through the Service infringes copyright, trademark, privacy, publicity, or another legal right, please contact us with:
- the URL of the relevant page;
- a clear description of the material and the right you believe is affected;
- an explanation of your authority or ownership;
- reliable contact information; and
- any supporting information reasonably necessary to assess the request.
We may remove, restrict, preserve, or restore material after reviewing a sufficiently detailed notice and the requirements of applicable law.
User Content and Submissions
If the Service allows comments, messages, feedback, or other submissions, you retain rights you lawfully hold in your User Content. You grant the Company a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, moderate, and transmit that User Content solely as reasonably necessary to operate, secure, promote, and improve the Service.
You represent that you have the rights and permissions necessary to submit the User Content and that it does not violate law or another person's rights.
Do not submit confidential, highly sensitive, or private information through a public comment. We may moderate, reject, hide, restrict, or remove User Content that we reasonably consider unlawful, harmful, misleading, infringing, abusive, spam-like, irrelevant, or disruptive.
Feedback
If you voluntarily send suggestions, ideas, bug reports, design feedback, or feature requests, you allow us to use that feedback without restriction or payment, provided that this does not transfer ownership of unrelated confidential material or personal information.
Third-Party Services and Links
The Service may include or link to Blogger, Google services, advertising providers, analytics tools, videos, fonts, social platforms, or other Third-Party Services. We do not control their content, availability, security, data practices, transactions, or terms.
Your use of a Third-Party Service is governed by that provider's terms and privacy policy. We are not responsible for losses or disputes arising solely from your relationship with a third party, except where applicable law provides otherwise.
Technical Requirements and Compatibility
You are responsible for obtaining a compatible Device, supported browser, internet connection, and any settings necessary to access the Service. Fullscreen, sound, touch, keyboard, animation, saving, and orientation behavior may vary between browsers and Devices.
We may stop supporting obsolete browsers, insecure configurations, or Devices that cannot reliably run current web standards.
Availability, Updates, and Maintenance
We may update, redesign, test, suspend, replace, restrict, remove, or discontinue a Game, page, feature, URL, visual design, or other part of the Service at any time for maintenance, security, legal, editorial, performance, or operational reasons.
We do not guarantee uninterrupted access, permanent availability of a specific Game, preservation of a particular design, backward compatibility, or immediate correction of every defect.
Suspension and Termination
We may restrict, suspend, or terminate access to all or part of the Service when we reasonably believe that you have materially breached these Terms, created a security or legal risk, interfered with the Service, abused another person, or when restriction is required by law or a service provider.
Where appropriate and reasonably practicable, we may provide notice or an opportunity to correct the issue. Provisions that by their nature should continue after termination will survive, including intellectual property, User Content licenses already necessary to operate prior submissions, disclaimers, liability provisions, governing law, and dispute terms.
Privacy and Data Protection
Our collection and use of personal information are described in the Privacy Policy. By using the Service, you acknowledge that browser storage, hosting providers, advertising, analytics, comments, and embedded Third-Party Services may process information as described there.
You must not use the Service to unlawfully collect, expose, scrape, publish, or misuse another person's personal information.
Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim express, implied, statutory, and other warranties, including warranties of accuracy, merchantability, fitness for a particular purpose, compatibility, availability, security, and non-infringement.
The more detailed limitations and risk notices in our Disclaimer also apply.
Limitation of Liability
To the fullest extent permitted by applicable law, the Company and its operators, contributors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, opportunity, goodwill, data, locally stored Game progress, or other intangible losses arising from or related to the Service.
If liability cannot lawfully be excluded, it will be limited only to the extent permitted by applicable law. Because most access to the Service is currently free, any monetary limitation based solely on fees paid may be zero; however, this does not exclude rights, remedies, guarantees, or liabilities that cannot lawfully be waived.
Indemnity for Unlawful Conduct
To the extent permitted by applicable law, you agree to be responsible for losses, claims, or reasonable costs arising directly from your unlawful use of the Service, material breach of these Terms, infringement of another person's rights, or malicious interference with the Service.
This section does not require a consumer to indemnify us for our own unlawful conduct, negligence, or a liability that applicable law does not allow us to transfer.
Governing Law
These Terms are governed by the laws of the Republic of Indonesia, without giving effect to conflict-of-law rules that would require the application of another jurisdiction's law.
Relevant Indonesian law may include the Electronic Information and Transactions framework under Law No. 11 of 2008 as most recently amended by Law No. 1 of 2024, Law No. 8 of 1999 on Consumer Protection, Law No. 28 of 2014 on Copyright, and Law No. 27 of 2022 on Personal Data Protection, each as amended, implemented, or replaced from time to time.
Mandatory Consumer and Local Rights
Nothing in these Terms excludes or limits a mandatory consumer right, statutory guarantee, privacy right, remedy, duty, or liability that cannot lawfully be excluded or limited.
If you are a consumer outside Indonesia, you may also benefit from mandatory protections under the law of your place of residence. Where mandatory law conflicts with these Terms, that law will control to the extent of the conflict.
Dispute Resolution
If a concern or dispute arises, please contact us first and provide enough information for us to understand the issue. We will attempt to resolve the matter informally and in good faith.
If the matter cannot be resolved, either party may pursue remedies available under applicable law. These Terms do not require mandatory private arbitration and do not prevent a consumer from contacting a competent regulator, consumer body, data-protection authority, or court where permitted by law.
Severability and Waiver
Severability
If a provision is held invalid, unlawful, or unenforceable, it will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
Waiver
A failure or delay in enforcing a right or provision is not a waiver of that right or provision. A waiver is effective only for the specific circumstance in which it is given.
Assignment
You may not transfer your rights or obligations under these Terms without our prior written permission. We may transfer these Terms in connection with a legitimate reorganization, merger, acquisition, financing, or transfer of the Service, subject to applicable law and your mandatory rights.
Entire Agreement
These Terms, together with the Privacy Policy, Disclaimer, and any feature-specific notice or supplemental terms, form the entire agreement between you and the Company concerning the Service and replace prior understandings about the same subject.
Translation
We may provide translations for convenience. Unless mandatory law requires otherwise, the English version will control if a translated version conflicts with the English version.
Changes to These Terms
We may update these Terms when our Games, technology, advertising arrangements, service providers, legal obligations, or operating practices change. The revised Terms will be posted on this page with a new "Last updated" date.
For material changes, we may provide an additional notice through the Website where reasonably appropriate or legally required. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by applicable law.
